These Terms of Service ("Terms") are a legal agreement between you and Jeremy Nando ("we", "us", "our") governing your use of the Arc mobile application ("Arc" or the "App"). By downloading, accessing, or using Arc, you agree to these Terms. If you do not agree, do not use the App.
You must be at least 18 years old to use Arc. By using the App you represent that you are 18 or older and able to form a binding contract.
Arc helps you track body weight, nutrition, hydration, workouts, and daily activity, and offers optional AI-assisted features (food photo estimation, workout plan generation, and motivational content). We may add, change, or remove features at any time.
You access Arc using Sign in with Apple. You are responsible for maintaining the security of your Apple ID and for all activity under your account. Notify us promptly of any unauthorized use.
Arc is not a medical device and does not provide medical advice.
The App provides general fitness and nutrition information for informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Calorie targets, macro estimates, workout plans, and AI-generated content are estimates and may be inaccurate.
Always consult a qualified healthcare professional before starting any diet, exercise, or weight-loss program, particularly if you are pregnant or nursing, have an eating disorder or history of one, or have any medical condition. Never disregard professional medical advice because of something in the App. If you think you may have a medical emergency, call your doctor or emergency services immediately.
You use the App and undertake any diet or exercise activity at your own risk.
AI features generate estimates and suggestions using third-party AI technology. Results (including nutrition values from photos, generated workout plans, and text) may be inaccurate or incomplete and should be reviewed with judgment. Do not rely on them as precise or authoritative. AI features may be subject to usage limits.
Food information is provided in part by third-party databases including Open Food Facts and USDA FoodData Central. This data is provided by those parties "as is" and may be inaccurate or incomplete. We do not control and are not responsible for third-party data or services. Your use of the App also relies on services from Apple, Supabase, and Anthropic.
You agree not to: (a) use the App for any unlawful purpose; (b) attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the App or its systems; (c) abuse or attempt to circumvent usage limits or security controls; or (d) submit content that infringes others' rights.
You retain ownership of the data and content you submit. You grant us a limited license to process it solely to operate and provide the App as described in our Privacy Policy.
The App, including its design, software, and branding, is owned by us and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms and the Apple App Store terms.
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that estimates and content will be accurate.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or health outcomes, arising from your use of or inability to use the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the service. Provisions that by their nature should survive termination will survive.
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Japan, without regard to conflict-of-laws rules.
Your use of the App is also subject to the Apple Media Services Terms and the standard Apple Licensed Application End User License Agreement (EULA). If these Terms conflict with Apple's terms regarding your use of the App, Apple's terms govern to the extent of the conflict. You acknowledge that Apple is not responsible for the App or its content and is not a party to these Terms.
